Terms of Service

1. Acceptance of Terms

By accessing or using Kendo Nexus ("the Platform"), operated by Ai Kendo Club, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. Description of Service

Kendo Nexus is a SaaS platform for the Kendo community that provides tools for individual practitioners (kendoka), club administrators, and tournament organisers. Features include training tracking, club management, attendance records, grading history, tournament organisation, and community tools.

3. User Accounts

• You are encouraged to provide accurate information when creating an account, as it helps your club administrators and the community identify you.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must be at least 13 years of age to create an account. Users under 18 require parental or guardian consent.
• You must notify us immediately of any unauthorised use of your account.

4. Club Administrator Responsibilities

If you register as a club administrator, you represent that you have the authority to act on behalf of the club. You are responsible for ensuring that member data entered into the Platform is collected and processed in accordance with applicable data protection laws and with the knowledge and consent of the individuals concerned.

5. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws.
• Upload or transmit harmful, offensive, or misleading content.
• Attempt to gain unauthorised access to any part of the Platform or its systems.
• Interfere with or disrupt the Platform or servers connected to it.
• Scrape, harvest, or collect data from the Platform without authorisation.
• Impersonate another person or misrepresent your affiliation with a club or organisation.

6. Intellectual Property

All content, design, graphics, logos, and software on the Platform are the property of Ai Kendo Club or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from any Platform content without prior written consent.

7. User Content

You retain ownership of content you submit to the Platform (such as training notes, diary entries, and profile information). By submitting content, you grant Kendo Nexus a non-exclusive, worldwide licence to store, display, and process that content solely for the purpose of providing the service to you and your club.

8. Service Availability

We strive to keep the Platform available at all times but do not guarantee uninterrupted access. We may suspend or discontinue the Platform (or any part of it) at any time for maintenance, updates, or other reasons. We will endeavour to provide reasonable notice of any planned downtime.

9. Limitation of Liability

To the fullest extent permitted by law, Kendo Nexus and Ai Kendo Club shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. The Platform is provided "as is" without warranties of any kind, whether express or implied.

10. Termination

We may suspend or terminate your account at our discretion if you violate these Terms. You may delete your account at any time. Upon termination, your right to use the Platform ceases immediately, though we may retain certain data as required by law or for legitimate business purposes.

11. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via the Platform or email. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
